suspensive effect

- приостановление приведения в исполнение арбитражного решения на территории определенной страны, обычно является следствием подачи заявления об отмене арбитражного решения в государственный суд этой страны (см. action to set aside). Российским процессуальным законодательством в отношении арбитражных решений, вынесенных на территории РФ, такого механизма не предусмотрено. Кроме того, приостановление приведения в исполнение арбитражного решения по месту его вынесения не препятствует его признанию и приведению в исполнение за рубежом на основании норм п. 1 ст. VII Нью-Йоркской конвенции, если процессуальным правом государства, где испрашивается признание и приведение в исполнение этого арбитражного решения, не предусматривается такое основание для отказа в удовлетворении ходатайства о признании и приведении в исполнение, как приостановка исполнения арбитражного решения государственным судом страны, на чьей территории оно было вынесено.
