positive public policy

- позитивный публичный порядок, доктринальный аргумент, в соответствии с которым существует и обязательно должна быть применена составом арбитража определенная сверхимперативная норма права (не обязательно входящая в состав норм материального права, которому подчинено спорное правоотношение) (см. mandatory law 2. rule of law), неприменение или неправильное применение которой может привести к отмене арбитражного решения или отказу в его признании и приведении в исполнение по причине нарушения публичного порядка. Один из компонентов доктрины публичного порядка (см. public policy).
