- 1. спор, ожидающий своего разрешения в другом юрисдикционном органе, суде или арбитраже, чье решение, возможно, будет иметь преюдициальное значение; 2. = lis alibi pendens - рассмотрение аналогичного спора в другом юрисдикционном органе, суде или арбитраже, чье решение будет являться препятствием для рассмотрения поданного искового заявления. См. п. 3 ст. II Нью-Йоркской конвенции.
