Обычно до того, как перейти к рассмотрению испрошенных средств правовой защиты (prayers for relief), состав арбитража формулирует основополагающие вопросы, от ответа на которые зависит исход спора (см. an debeatur). В больших разбирательствах такие ответы могут быть изложены в отдельном арбитражном решении (preliminary award).
