conflict of interests
- конфликт интересов, ситуация, при которой лицо, имевшее определенную связь с одним или несколькими участниками арбитражного спора или его предметом, не может поэтому считаться в должной степени независимым и беспристрастным (см. independence), чтобы исполнять функции арбитра (arbitrator). Лицо, которому предложено быть арбитром, обязано немедленно информировать стороны о возможном наличии у него конфликта интересов, если это сделано не будет, то такому арбитру может быть заявлен отвод (см. challenge 1. of arbitrator, removal of arbitrator), а арбитражное решение может быть оспорено (см. action to set aside).
